1. Agreement to Terms

By accessing and using AllShare (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

AllShare ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Changes become effective immediately upon posting to the website. Your continued use of the Service constitutes acceptance of the modified Terms.

2. Service Description

AllShare is a web-based photo and video sharing platform that allows users to:

• Create private galleries for events (weddings, birthdays, stag dos, hen dos).
• Upload and store photos and videos.
• Share galleries with guests via unique links.
• Download media from galleries.
• Manage media storage with plan-based limits.

The Service is provided "as-is" and "as-available" without guarantees of uninterrupted availability or error-free operation.

3. User Accounts

3.1 Account Eligibility

To use AllShare, you must:

• Be at least 13 years old (18 in some jurisdictions).
• Have the legal capacity to enter into a binding contract.
• Not be a minor or guardian of a minor (unless 18+ and authorizing minor usage).
• Reside in a country where AllShare is available.
• Provide accurate, current, and complete information during registration.

3.2 Account Registration

You are responsible for:

• Maintaining the confidentiality of your password and account credentials.
• All activities that occur under your account.
• Notifying us immediately of unauthorized access or use.
• Keeping your account information accurate and up-to-date.

We are not liable for unauthorized access if you fail to protect your credentials.

3.3 Anonymous & Guest Uploads

Guests can upload photos to your gallery via the shared link without creating an account. AllShare is not responsible for guest conduct or the content guests upload.

4. Acceptable Use Policy

4.1 Prohibited Content

You agree NOT to upload, store, or share any content that:

• Illegal: Violates any local, state, or international law.
• Abusive: Contains hate speech, harassment, bullying, or threats toward individuals or groups.
• Exploitative: Contains child abuse material, exploitation, or grooming.
• Sexual: Contains non-consensual intimate imagery (revenge porn), pornography, or sexually explicit content.
• Violent: Depicts graphic violence, gore, self-harm, or torture.
• Malicious: Contains malware, viruses, or code designed to damage systems.
• Spam: Commercial spam, unsolicited advertising, or bulk promotional content.
• Copyright Infringement: Violates copyrights, trademarks, or intellectual property rights (excluding personal photos).
• Privacy Violation: Contains personal information of others without consent (names, addresses, phone numbers, etc.).

4.2 Prohibited Conduct

You agree NOT to:

• Attempt to hack, exploit, or gain unauthorized access to AllShare systems.
• Use automated tools (bots, scrapers) to access the Service without permission.
• Reverse-engineer or attempt to decompile our software.
• Impersonate another user or create fake accounts.
• Sell, transfer, or license access to your account.
• Engage in any form of abuse, harassment, or threatening behavior toward other users or staff.
• Attempt denial-of-service (DDoS) attacks or other malicious network activities.
• Spam or flood the Service with requests, data, or messages.
• Share login credentials publicly or with unauthorized parties.

4.3 Enforcement

Violations of this Acceptable Use Policy may result in:

• Immediate removal of prohibited content.
• Account suspension or termination.
• Legal action and prosecution (for serious violations).
• Reporting to law enforcement if necessary.

5. Intellectual Property Rights

5.1 User Content Ownership

You retain full ownership of photos and videos you upload to AllShare. We do NOT own, claim rights to, or profit from your content.

5.2 License to AllShare

By uploading content, you grant AllShare a limited license to:

• Store and display your content on your gallery.
• Share content with guests via your shared link.
• Create backups for data protection and recovery.
• Use content for technical support (with your permission).

This license is not exclusive—you may use your content elsewhere. The license terminates when your account is deleted.

5.3 AllShare Intellectual Property

All AllShare content, design, code, logos, and trademarks are owned by AllShare and protected by copyright law. You may NOT:

• Copy or reproduce our interface or design.
• Use our logos or branding without permission.
• Claim ownership of our software or features.

5.4 Third-Party Services

AllShare uses third-party services (Firebase, Stripe, Google Analytics) that have their own intellectual property. You agree to respect their rights as outlined in their respective agreements.

6. Data & Storage

6.1 Storage Limits

Each plan includes specific storage limits:

• Free: 200 MB for 7 days, 1 album
• Bronze: 2 GB for 3 months, up to 3 albums
• Silver: 5 GB for 6 months, up to 10 albums
• Gold: 15 GB for 12 months, unlimited albums

Once storage is full, you cannot upload additional content until you delete existing files or upgrade your plan.

6.2 Plan Expiration

When your plan expires:

• Your gallery becomes read-only (no new uploads).
• You have a 30-day grace period to download or save your media.
• After 30 days, all content is permanently deleted without recovery option.
• We are not liable for data loss after the grace period.

6.3 Backups & Recovery

We maintain automated backups for technical recovery purposes only. Backups may persist for up to 30 days after deletion. We make no guarantee of data recovery and are not liable if recovery is not possible.

6.4 User Responsibility

You are responsible for:

• Maintaining your own backup copies of important content.
• Monitoring your storage usage and plan expiration date.
• Downloading content before plan expiration.

7. Payments & Billing

7.1 Payment Terms

Payment for Bronze, Silver and Gold plans is a one-time charge, processed through Stripe. By purchasing, you authorize the charge to your payment method.

7.2 Pricing

Prices are as follows (subject to change with notice):

• Free Plan: £0 (7-day trial)
• Bronze Plan: £5.99 one-time (3 months)
• Silver Plan: £9.99 one-time (6 months)
• Gold Plan: £14.99 one-time (12 months)

7.3 Billing Errors

If you notice a billing error, contact us within 30 days of the charge. We will investigate and correct the error if confirmed.

7.4 Refunds

Refunds are governed by our Returns & Refunds Policy. Please review that policy for eligibility and procedures.

7.5 No Refund for User Cancellation

Plan purchases are final. If you cancel your plan, no refund is issued unless you qualify under our Refunds Policy.

8. Limitation of Liability

8.1 Disclaimer of Warranties

The Service is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, express or implied. We make no warranty that:

• The Service will be uninterrupted, error-free, or secure.
• Defects will be corrected or avoided.
• Your data will never be lost or corrupted.
• Third-party services (Firebase, Stripe) will function perfectly.

8.2 Limitation on Damages

To the maximum extent permitted by law, AllShare is NOT liable for:

• Lost or corrupted data (except where we are directly at fault).
• Lost profits, revenue, or business opportunity.
• Indirect, incidental, special, or consequential damages.
• Third-party claims or actions.

Our total liability to you shall not exceed the amount you paid for your plan in the past 12 months.

8.3 Service Availability

We aim for 99.5% uptime but do not guarantee continuous availability. We are not liable for:

• Scheduled maintenance or updates.
• Third-party service failures (Firebase, Stripe, Google).
• Internet connectivity issues on your end.
• Force majeure events (natural disasters, pandemics, etc.).

9. Indemnification

You agree to indemnify and hold harmless AllShare, its owners, employees, and agents from any claims, damages, losses, or liabilities arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your content or conduct.
• Your interaction with other users.
• Claims that your content infringes third-party rights.

10. Termination

10.1 Termination by User

You may terminate your account at any time by:

• Requesting deletion via your account settings.
• Emailing support@allshare.co.uk

Your account and all associated data will be deleted within 30 days.

10.2 Termination by AllShare

We may suspend or terminate your account without notice if you:

• Violate the Acceptable Use Policy.
• Engage in illegal activity.
• Abuse the Service or other users.
• Have outstanding chargebacks or fraud disputes.
• Violate any term of this Agreement.

10.3 Effect of Termination

Upon termination:

• Your access to the Service is immediately revoked.
• Your data is deleted within 30 days (no recovery possible).
• Any outstanding billing obligations remain due.

11. Privacy & Data Protection

Your privacy is governed by our Privacy Policy. By using AllShare, you consent to the collection, use, and transfer of your information as described in that policy.

12. Third-Party Services

12.1 Firebase (Google Cloud)

AllShare uses Firebase for data storage and authentication. Your data is subject to Firebase's Terms of Service and Privacy Policy. We are not responsible for Firebase outages or data loss due to Firebase failures.

12.2 Stripe

Payments are processed through Stripe. Stripe's privacy and security measures apply. AllShare does not access or store your payment details.

12.3 Google Analytics

We use Google Analytics to understand user behavior. Analytics is governed by Google's Privacy Policy.

13. Dispute Resolution & Governing Law

13.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be exclusively subject to the jurisdiction of the courts of England and Wales.

13.3 Dispute Resolution

Before pursuing legal action, you agree to:

1. Contact us: Email support@allshare.co.uk with details of your dispute.
2. Negotiation Period: Attempt to resolve the dispute informally within 30 days.
3. Escalation: If unresolved, either party may pursue legal action.

14. Modifications to Service

AllShare reserves the right to:

• Modify, suspend, or discontinue features at any time.
• Change storage limits or pricing (with notice).
• Alter user interface or design.

We will provide reasonable notice for significant changes. Continued use after notice constitutes acceptance of changes.

15. Advertising & Promotions

AllShare does not display advertisements within the Service. We may:

• Send promotional emails about new features (with opt-out option).
• Offer limited-time discounts or referral incentives.

Promotional offers have specific terms—read all terms before accepting.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refunds Policy, constitute the entire agreement between you and AllShare regarding the Service. Any prior agreements, understandings, or representations are superseded.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, or if not possible, severed. The remaining provisions shall continue in full force and effect.

19. Changes to Terms
